Terms of service

1. Who you are contracting with

Tejaki is a product and platform of Blowtrumpet Technologies, a company incorporated in India with its registered office at Greater Kailash II, New Delhi, India (“Blowtrumpet”, “we”, “us”). Tejaki is not a separate legal entity and does not contract in its own right. Your counterparty, and the company that pays you, is Blowtrumpet Technologies.

These Terms apply for the benefit of Blowtrumpet Technologies and of its branches, offices, divisions, subsidiaries, associates, allied and sister concerns and group companies, whether presently in existence or established, incorporated or acquired at any time in the future.

By using Tejaki you agree to these Terms, our Privacy Policy, our Community Guidelines and our Unsolicited Idea Submission Policy.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. You must be able to provide the identity and tax information we need in order to pay you lawfully.

3. How we transact with you

Blowtrumpet contracts as principal. We buy inventory from you in our own name and separately sell finished media products to advertisers in our own name. We are not your agent, we are not a broker introducing you to an advertiser, and we do not represent you in dealings with advertisers.

Offers. We make you an offer at a stated rate for defined inventory. You accept or decline. An accepted offer is a contract between you and Blowtrumpet.

Independent pricing. What we pay you is determined independently of what any advertiser pays us.

Payment on verified delivery. We pay you once delivery is verified, through a licensed payment service provider, irrespective of whether or when an advertiser has paid us.

Your balance is an account payable owed by Blowtrumpet to you. Only Blowtrumpet credits it. You cannot fund it, it carries no stored value, and it is not transferable to any other person.

Withholding. We withhold tax on our own payment to you as required by Indian law, and provide the corresponding documentation.

No pass-on of advertiser risk. Advertiser non-payment is our exposure, not a reason to delay or reduce what we owe you.

4. Your content and your channel

You keep full ownership of your content, your channel and your audience relationship. You grant Blowtrumpet a limited, non-exclusive, worldwide, royalty-free licence to deliver advertiser creative into inventory you have accepted, and to record and verify that delivery.

You will: run accepted inventory as agreed; not misrepresent your audience, reach or engagement; not use bots, artificial traffic, incentivised viewing or any other means of inflating delivery or engagement; comply with the platform rules of the services you stream or publish on; and keep your content lawful and consistent with our Community Guidelines.

5. Exclusivity

Accepting an offer does not make you exclusive to Blowtrumpet. You remain free to work with anyone else, except where a specific offer states a limited category or time restriction on its face and you accept it on those terms.

6. Verification and disputes

Verified delivery records are the reference for payment. If you believe a record is wrong, raise it within 30 days and we will investigate in good faith and correct genuine errors.

7. Gamified elements

Keys, points, experience, reputation and levels are non-financial, carry no monetary value, are not redeemable for cash, are not transferable and are not a payment instrument or stored value. They are recognition, never remuneration.

8. Data protection

Blowtrumpet is a Data Fiduciary for your personal data and processes it as described in our Privacy Policy, under the Digital Personal Data Protection Act, 2023. Blowtrumpet processes no viewer personal data in the course of serving advertising into your content.

9. Suspension and termination

We may suspend or terminate your account for breach, fraud, artificial inflation of delivery, legal requirement or security risk. You may close your account at any time; we will pay you everything owed for verified delivery up to that point. Where we can, we give notice before terminating, unless immediate action is needed.

10. Closed testing

Tejaki is in closed testing. Access is limited, features may change or be withdrawn, and anything described on this website may not be generally available.

11. Intellectual property

All platform software, designs and documentation are owned by or licensed to Blowtrumpet. Tejaki™, Blowtrumpet™, Ravaki™ and State of Ads™ are trade marks of Blowtrumpet Technologies; registration has been applied for. Your content and your marks remain yours.

12. Disclaimer and liability

The platform is provided “as is” and “as available”. To the maximum extent permitted by law, Blowtrumpet is not liable for indirect, incidental or consequential damages, including lost future earnings. Nothing here limits our obligation to pay you for verified delivery. Our liability for direct damages is otherwise limited to the greater of INR 10,000 or the amounts we paid you in the preceding six months.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Delhi have exclusive jurisdiction over any dispute arising out of or in connection with them.
